Whether you own a Condo or a Townhouse in fee simple, your
homeowner's association has the obligation to repair items that become damaged or
deteriorated on or about your unit. That's what you get for your monthly maintenance fee.
Generally, these would include the roof, siding, steps, sidewalks, landscaping, trees,
drainpipes, etc. but this group may not include windows and doors
Often, the association bylaws and/or covenants and
restrictions specifically exclude from its responsibility windows and doors, and possibly
skylights as well. Some associations treat skylights as part of the roof structure.
Windows are especially vulnerable where they are insulated or double pane glass
(thermopane). When the seals become weakened, moisture can infiltrate between the glass
panels, and the windows become foggy looking. Though you may learn to live with it, buyers
may not and will expect that the windows be replaced.
Whose responsibility is it to make the repair depends upon your association documents.
(Read
them to be sure. Alternately, call you Association Manager or its President.) As

home. Usually these windows are warrantied, and if the defect occurs during the
warranty period, it may be neither your expense nor the association's; however, in older
developments, the warranty ,may have expired. But if it is your responsibility, know
about it early on so it doesn't become a deal breaker.
